These Terms & Conditions (“Terms”) govern your use of the website (www.swiftshiftpackers.online) and the packing & moving services provided by SwiftShift Packers & Movers Pvt. Ltd. (“SwiftShift,” “we,” “us,” or “our”).

By accessing our website or engaging our services, you (“User,” “Customer,” or “you”) agree to be bound by these Terms. If you do not agree, please do not use our website or services.

These Terms are governed by the following Indian laws: the Indian Contract Act, 1872; Consumer Protection Act, 2019; Consumer Protection (E-Commerce) Rules, 2020; Information Technology Act, 2000; the Companies Act, 2013; and the Arbitration and Conciliation Act, 1996.

2. Company Information

SwiftShift Packers & Movers Pvt. Ltd. is a Private Limited Company registered in the state of Haryana, India, under the Companies Act, 2013.

Business Relationship Disclosure: Pentrix Hub may support SwiftShift with website management, advertising operations, and initial lead coordination. Unless explicitly stated otherwise, all quotations, bookings, invoices, complaints, and service fulfilment are handled by SwiftShift Packers & Movers Pvt. Ltd.

Company Verification Documents: Customers, corporate clients, and due-diligence teams may request basic company verification documents through our official email or WhatsApp channels. Documents are available on request through our official channels.

3. Services We Provide

SwiftShift provides professional packing and moving services across 15 states in India:

  • Home Relocation: Complete household shifting with packing, loading, transport, unloading, and unpacking.
  • Domestic Relocation: Intercity and interstate moving services.
  • Office Shifting: Corporate and commercial relocation including furniture, IT equipment, and documents.
  • Packing & Unpacking: Standalone professional packing and unpacking services.
  • Vehicle Transport: Car and two-wheeler transport via enclosed carriers.
  • Warehouse & Storage: Short-term and long-term secure storage solutions.

Service availability may vary based on location, season, and operational capacity. We reserve the right to decline or modify service requests based on feasibility and safety considerations.

4. Pricing & Quotations

All prices displayed on our website are starting prices only and are intended for indicative purposes. Final pricing depends on the actual distance, volume of goods, special handling requirements, floor access, and other specific circumstances of your move. A detailed and final quote is always confirmed with you before any work begins.

  • Website prices represent the minimum starting cost for each service category and do not constitute a binding offer.
  • A final quote is provided after we assess your specific requirements through phone, WhatsApp, or an on-site survey.
  • The final confirmed quote includes all agreed-upon services, materials, and logistics. Any additional services requested after confirmation may incur extra charges, which will be communicated and agreed upon before proceeding.
  • Prices are subject to change based on fuel costs, toll charges, government levies, and other external factors beyond our control.

4.1 GST & Taxes

All quoted prices are inclusive of GST at the applicable rate (currently 18% for packing and moving services). A GST-compliant tax invoice is provided with every booking. Corporate customers can claim Input Tax Credit (ITC) on our invoices where applicable. SwiftShift is solely responsible for remitting GST to the government.

5. Booking & Confirmation

A booking is considered confirmed only when all three of the following have occurred:

  • You have received a final quote from our team and explicitly accepted it via WhatsApp, email, or phone.
  • The required advance payment (20–30% of the quoted amount) has been received by us.
  • A written or digital confirmation (via WhatsApp or email) has been sent to you by our team with your booking details.

Mere inquiry or receipt of a quote does not constitute a confirmed booking.

6. Cancellation & Refunds

For our complete cancellation and refund policy, including timelines, applicable charges, and refund procedures, please refer to our Cancellation & Refund Policy.

Key points:

  • Cancellations more than 72 hours before the scheduled move are eligible for a refund of the advance payment.
  • Cancellations between 24–72 hours before the move are eligible for 50–75% refund.
  • Cancellations less than 24 hours before the move or after dispatch are not eligible for a refund.
  • Refunds are processed within 7–10 business days to the original payment method.

7. Customer Responsibilities

As a customer, you agree to the following:

  • Accurate Information: Provide accurate and complete details regarding your move, including addresses, inventory, access conditions (stairs, lifts, parking), and any special handling items.
  • Prohibited Items: Do not include illegal, hazardous, flammable, explosive, or perishable items without prior written disclosure and our approval. Undisclosed prohibited items are your sole liability.
  • Access & Permissions: Ensure access to both pick-up and delivery locations, including any necessary permissions from housing societies, building management, or landlords.
  • Presence or Representative: You or an authorised representative must be present at both pick-up and delivery locations during the move.
  • Valuables: Cash, jewellery, important documents, and other irreplaceable valuables should be carried personally. SwiftShift is not liable for items of extraordinary value unless separately declared and insured.
  • Timely Communication: Communicate any changes to the schedule, location, or inventory promptly.
  • Inventory Checklist: Review and sign the inventory checklist prepared by our crew before and after the move. Any discrepancy must be noted on the checklist at the time of delivery.

8. Limitation of Liability

We take every reasonable precaution through professional packing and careful handling to ensure your belongings are transported safely:

  • SwiftShift shall not be held liable for loss or damage arising from circumstances beyond our reasonable control, including natural disasters, accidents, road conditions, government restrictions, strikes, civil unrest, or force majeure events.
  • Our liability for damage to goods packed by our crew is limited to the terms of the applicable transit insurance. For items without insurance, our maximum liability is limited to ₹50 per kilogram of the damaged item’s weight, unless a higher declared value with premium insurance was agreed upon at the time of booking.
  • We are not liable for damage to items that were self-packed by the customer or for pre-existing damage not disclosed at the time of the inventory check.
  • We strongly recommend transit insurance for high-value items. See our Service Policy for insurance options.
  • All damage claims must be reported within 48 hours of delivery, with photographic evidence, to be eligible for review.

8.1 Vehicle Transport Liability

For car and bike transport services, our liability for transit damage is governed by the terms of the transport agreement and any transit insurance in effect. Minor cosmetic damage (scratches, minor dents) that may occur during loading, unloading, or transit is covered under our standard basic insurance. Major damage or total loss claims require comprehensive transit insurance, available at the time of booking. All vehicle transport is conducted in compliance with applicable Motor Vehicles Act, 1988 requirements.

9. Service Warranty Disclaimer

We take every reasonable precaution through professional packing and careful handling to ensure your belongings are transported safely. Delivery timelines are estimated and communicated during the booking process. Please note:

  • Delivery times are estimated windows, not fixed arrival times.
  • While we use multi-layer packing and careful handling, minor wear during transit cannot always be avoided.
  • Service availability on specific dates during peak seasons (Diwali, year-end, first-of-month) or adverse weather.

This disclaimer does not affect your statutory rights under the Consumer Protection Act, 2019.

10. Intellectual Property

All content on our website — including text, graphics, logos, icons, images, and software — is the property of SwiftShift Packers & Movers Pvt. Ltd. and is protected by Indian intellectual property laws.

  • The “SwiftShift” name, logo, and all related marks are trademarks of SwiftShift Packers & Movers Pvt. Ltd.

11. Website Use & E-Commerce Compliance

  • All bookings are confirmed through direct communication (WhatsApp, phone, or email) after a personalised quote is provided.
  • We do not use manipulative UI patterns (dark patterns) to mislead users into unintended actions.
  • All service details, pricing disclaimers, and contact information are displayed transparently on the website.

You agree not to use our website for any unlawful purpose, attempt to gain unauthorised access to any portion of the website, use automated tools to scrape data, upload harmful code, or impersonate any person or entity.

13. Indemnification

You agree to indemnify and hold harmless SwiftShift Packers & Movers Pvt. Ltd., its directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your breach of these Terms, misuse of our services, or violation of any applicable law.

14. Consumer Rights & Grievance Redressal

Under the Consumer Protection Act, 2019, you have the right to:

  • Be informed about the quality, quantity, potency, purity, standard, and price of goods or services.
  • Be protected against unfair trade practices and unscrupulous exploitation.
  • Seek redressal against deficiency in service.

Internal grievance process:

External redressal: If you are not satisfied with our internal resolution, you may approach the relevant Consumer Disputes Redressal Commission (District, State, or National level) under the Consumer Protection Act, 2019. You may also file a complaint on the National Consumer Helpline at 1800-11-4000 or through the consumerhelpline.gov.in portal.

15. Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms or our services:

  • Amicable Resolution: Both parties shall first attempt to resolve the dispute through direct communication and negotiation.
  • Mediation: If amicable resolution fails, the dispute may be referred to mediation before an independent mediator agreed upon by both parties.
  • Arbitration: If mediation is unsuccessful, the dispute shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Gurgaon, Haryana. The language of proceedings shall be English.

Nothing in this section prevents you from approaching a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, which is available to you as a statutory right.

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, Haryana, India, subject to the consumer’s statutory right to file complaints at the consumer forum of their own jurisdiction.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. For significant changes, we will make reasonable efforts to notify you. Your continued use of our website or services after changes constitutes your acceptance of the revised Terms.

19. Entire Agreement

These Terms, together with our Privacy Policy, Cancellation & Refund Policy, Service Policy, Payment Policy, Disclaimer, Cookie Policy, Safety & Verification Policy, and Communication Policy, constitute the entire agreement between you and SwiftShift Packers & Movers Pvt. Ltd. regarding your use of our website and services.
